Applegate will leave CPE for foundation
Jim Applegate, vice president for academic affairs at the state Council on Postsecondary Education, has been named senior vice president of the Lumina Foundation on Education in Indianapolis. His appointment is effective Oct. 1. Lumina, which has assets of $1.5 billion, is one of the nation's few major foundations devoted to issues involving low-income, minority and adult learners. "It's a perfect job for Jim," said Lee Nimocks, the council's chief of staff. "He is such an evangelist on those issues."

Soldier appeals in Iraqi detainees murder case
A Tennessee soldier found guilty of negligent homicide for ordering his subordinates to kill Iraqi detainees has filed an appeal against his conviction and sentence of 10 years in prison.Staff Sgt. Ray Girouard, of Sweetwater, was found guilty by a military jury last year at Fort Campbell, Ky., in the deaths of three detainees during a 2006 raid near Samarra, Iraq.The appeal, filed Monday with the U.S. Army Court of Criminal Appeals, argues that it is against military policy to hold a leader responsible for the intentional killings by his subordinates during combat missions.Girouard was the most senior of four 101st Airborne Division soldiers found guilty in the case. Spc. William Hunsaker and Pfc. Corey Clagett both pleaded guilty and testified Girouard ordered them to release the detainees and shoot them as they fled.Girouard was the only soldier who refused to take a plea deal in the case and took the stand to deny ordering the killings. After he discovered the slayings, Girouard testified that he decided to help them fake an attack, cutting Hunsaker and punching Clagett in the face, and lying to superiors by saying his soldiers shot the detainees in self-defense.

City settles overtime lawsuit with jail officers
The city has settled a lawsuit about overtime pay for more than 300 current and former Fayette County Detention Center corrections officers. The details of the settlement . including the total amount . will not be made public until a hearing next week before U.S. District Judge Jennifer Coffman, who must approve the settlement agreement. Attorney Tom Miller, who represents the corrections officers, confirmed Thursday that the lawsuit had been settled earlier this month. The lawsuit alleges that the city had engaged in long-standing, widespread and multiple violations of the federal Fair Labor Standards act and the Kentucky Wage and Hours Act.

A Morehead State University student is recovering after a falling from a banister on campus.University police received a call at about 10 p.m. Wednesday night that second-year student Ross Timothy Healy had fallen while sliding down a three-story banister at Adron Doran University Center.University spokesman Jason Blanton says a witness reported that Healy made it about halfway down, then fell about 26 feet to the ground.Blanton says that Healy was in fair condition Thursday morning at University of Kentucky Hospital where he was being treated for "numerous injuries."Blanton says it was the first injury that has been reported from sliding down the banister at the university center.

Police looking for suspect who fired at officers
Police in central Kentucky say they are searching for a person who fired shots at officers in a mobile home park.Campbellsville Police spokesman Ronnie Dooley said officers were at the Sycamore Trailer Park Thursday morning to follow-up on an investigation when someone fired shots at them.State police say one bullet struck the ground near the officers.Police have evacuated a small number of residents in the park and are searching for the suspect.Dooley says officers have narrowed the potential source of the shots to a few mobile homes.

A 58-year-old man remained in jail and a woman was hospitalized in critical condition after what Kentucky State Police described as a brutal attack.Trooper Steve Pavey says Ernest Pine of Breckinridge County attacked the woman, raped and sodomized her on Monday. Pavey said Pine slit the woman's throat and left her for dead after the attack.Pavey says the woman called a neighbor, who called police. Pavey said the victim told police that Pine was the attacker before she was airlifted to the hospital.Pine was being held in the Breckinridge County jail on Thursday and is charged with rape, sodomy, burglary and attempted murder. Jail records had no attorney listed for Pine.The victim is still in critical condition at University Hospital in Louisville.
