Prosecutor wants to release even more text messages
Even as a judge is set to rule Friday on the possible public release of about 200 text messages, the Wayne County Prosecutor's Office says it is primed to unload another batch of the texts written by Detroit Mayor Kwame Kilpatrick, his former aide Christine Beatty and others.The revelation of new text messages came Wednesday, one day after Kilpatrick blasted Prosecutor Kym Worthy, accusing her, among other things, of playing to racism in the region in a desperate bid to convict him of felony charges."Every time you turn around they serve you notice they want to do some more," Mayer Morganroth, the lawyer for Beatty, Kilpatrick's codefendant, said of prosecutors' latest plans. "The judge hasn't even ruled yet on their first motion and here they come again and want to release more messages. They're having fun, I guess, but it's just a waste of time."The prospect of another set of explosive messages was revealed late Wednesday as Kilpatrick's lawyers went to court to block prosecutors' plans.The mayor's lawyers cited a letter written Monday by Assistant Prosecutor Robert Moran notifying them he planned to file a court motion by the middle of next week with "numerous text messages from your client and others."The prosecution's letter did not specify the content of the new messages. But it was written the day before prosecutors amended criminal charges against the mayor to accuse him of lying at a police whistle-blower trial about extramarital affairs with women in addition to Beatty, his former chief of staff. Romantic messages the Free Press published in January between Kilpatrick and Beatty first brought their testimony into question.Kilpatrick's lawyers asked Detroit 36th District Judge Ronald Giles, who is hearing the early stages of the criminal case, to block the release of the new text messages. Giles likely will consider the request Friday as he announces whether he will allow prosecutors to release other messages involving the mayor and Beatty.Defense lawyers accuse prosecutors of attempting to taint potential jurors if the criminal cases ever go to trial. They also contend that Worthy obtained the texts in violation of federal communications laws. Prosecutors counter that the texts are valid evidence and that the mayor is seeking special treatment to keep the text messages secret.Kilpatrick and Beatty are charged with perjury and other felonies arising from their testimony in the whistle-blower trial last summer and a subsequent effort to keep the text messages secret in an $8.4 million settlement of the police cases in October.Late Wednesday, City Councilman Kwame Kenyatta accused Kilpatrick of portraying himself as the "poor, black, young leader" in his public attacks on Worthy, including raising the specter that race has played a role in Worthy's prosecution strategy."Not only is his entire legal team made up of white lawyers, but 90 percent of his legal defense fund is made up of donors from outside of the city of Detroit, who are mainly white businessmen," Kenyatta said.
