CLC seeks Supreme Court ruling on ei surplus
OTTAWA -- The Canadian labour movement is heading to theSupreme Court of Canada on Tuesday seeking a declaration that a$54-billion surplus that accumulated in the federal employmentinsurance fund was spent in an unconstitutional way and should bereturned to employers and employees. Two large Quebec unions and theCanadian Labour Congress will argue the surplus, which was divertedto general revenue and spent on such things as debt reduction,amounted to an indirect tax that was spent in an abusive way. "Insystematically accumulating a significant and excessive surplus andin using that surplus for non-employment insurance related purposes,the federal government has exceeded its constitutional authority,"the Canadian Labour Congress, an intervenor in the case, contends ina court brief.
