OTTAWA -- A New Brunswick miner who was forced off the job atage 65 lost his appeal in the Supreme Court of Canada on Fridaymorning. The case marks the first time in almost two decades thatthe Supreme Court has weighed in on the contentious issue ofmandatory retirement. Laws forcing workers off the job at age 65have been abandoned in every province but Nova Scotia, which intendsto ban mandatory retirement in 2009. However, several provinces,including New Brunswick, Alberta, Prince Edward Island andNewfoundland and Labrador allow exceptions when a company's pensionplan is designed around retirement at age 65.
